Order On order of the Court, the application for leave to appeal is considered, and, pursuant to MCR 7.302 (F)(1), in lieu of granting leave to appeal, we MODIFY the Court of Appeals judgment. Neither the trial court nor the Court of Appeals should have considered the merits of the question of jurisdiction over Walsh when deciding whether he should be added as a party. We REMAND the case to the Montcalm Circuit Court for further proceedings, including reconsideration of the motion to add Walsh as a party. In all other respects, leave to appeal is DENIED.
